Sheila O’briens petition for a special prosecutor included the following questions for Kim Foxx:
When you said you “recused” yourself from the Jussie Smollett case but still communicated with your staff about the Jussie Smollett case?
When you received a document from one of your assistants who told you that the law of Illinois was that your recusal would require a special prosecutor and you did not comply with that law 55 ILCS 5/3-9008?
When you communicated with a private attorney about Jussie Smollett?
When you communicated with the family of Jussie Smollett?
When you agreed to seal the People v. Jussie Smollett court file?
When your office nolle prossed a 16 count indictment against Mr. Smollett?
When you “invited” the Office of the Inspector General to “investigate” your handling of the People v Jussie Smollett case knowing that he is not a prosecutor, can only investigate past facts, and cannot take any action in the Jussie Smollett case like a special prosecutor can?
When you asked Judge Hawkins not to allow the Inspector General to see the grand jury proceedings in People v. Jussie Smollett, thus controlling the “investigation” by the Inspector General?
When you refused and still refuse to answer the public’s question about your role as State’s Attorney in People v. Jussie Smollett?
Why are you fighting so hard to keep Judge Martin, when there are hundreds of judges in Cook County and around the State who do not have a son hired by you/your administration and are not working for you, and under your supervision?
Opinion: Foxx knowingly broke the law, 55 ILCS 5/3-9008, and should be indicted. If guilty, she should be disbarred.
